GENERAL CONDITIONS

These general terms and conditions apply to the ordering of Interactive Fitness Sverige AB’s services marketed under the name “PUSH Training Pucks” or “PUSH Pucks”. By ordering a product provided by Interactive Fitness Sverige AB (hereinafter the Supplier) or by signing up for the Supplier’s e-mail newsletter, you (hereinafter the User) are deemed to have accepted these terms and conditions (hereinafter the Terms). The Provider reserves the right to change the Terms at any time without prior notice.

1. Introduction
The Supplier provides products for sport, leisure and related products. The User is responsible for any damage to the Product if the User or someone close to the User has been negligent.
The Supplier is responsible for delivering the Product in accordance with the User’s order and for fulfilling its part of the agreement in a lawful, commercial and customer-oriented manner. The Supplier reserves the right to use subcontractors in order to deliver in accordance with what has been promised.

2. Orders
Unless otherwise expressly stated, an agreement shall be deemed to have been concluded between the User and the Supplier when the User has placed an order on the Supplier’s website and the User has received an order confirmation from the Supplier to the e-mail address provided in connection with the order (hereinafter the Agreement). In order for the User to complete the order, the User must accept the Terms and Conditions and the Supplier’s privacy policy.
The User is responsible for providing correct data and information in connection with the order. The Supplier has the right to request additional information from the User before the Agreement is entered into, if this is required for the Supplier to be able to ensure the fulfillment of its rights under the Agreement. If the Supplier discovers that this information is incorrect in any respect, the Supplier is entitled to terminate the Agreement and recall the Product.

3. Prices
All prices quoted on the Supplier’s website are in SEK. The price quoted when ordering the Product is the price that shall be deemed to have been agreed between the Supplier and the User.

4. Payments
Vid utebliven betalning har Leverantören rätt att erhålla dröjsmålsränta enligt räntelagens bestämmelser från den tid betalning skulle ha skett till dess full betalning har skett. Leverantören förbehåller vidare sig rätten att välja och ändra betalningslösning framöver och som ett led i detta fortsätta använda sig av externa betalningslösningar.

5. Delivery and returns
After placing an order, the Supplier will ship the Product as soon as possible. Usually, the Product is delivered within 1-3 working days from the completion of the order, but due to subcontractors, the delivery time may be longer.
The Product is sent traceable. Delivery costs are paid by the User unless otherwise expressly stated. The current delivery cost is stated in connection with the order and if the User approves the order, the User is deemed to have approved the delivery costs and the conditions that otherwise apply to the current delivery option. 6. Right of withdrawal
If the User is a private customer, the Distance Contracts Act applies. This means that the User, provided that he/she is a private customer, has the right to cancel the Agreement within 14 days of the User receiving the Product. When exercising the right of withdrawal, the User is responsible for the cost of returning the Product and the risk until the Product has been received by us. 7. Warranty
The warranty covers defects in the Product that are not attributable to negligent use. The warranty means that the User is entitled to receive a new Product in the event of a defect in the Product.

8. Usage
The User and persons in the vicinity may use the Product for the purpose for which it is intended, i.e. as a training tool. The use of the Product requires that the User has read the instructions attached to the Product and available on the Supplier’s website to the required extent before use. The User and its users may not use the Product for illegal purposes or in a way that causes damage or other inconvenience to the Supplier or third parties.

9. Force majeure
If the Supplier is prevented from fulfilling its obligations due to circumstances beyond its control, such as lightning, fire, pandemic, war and government regulations, as well as errors or delays in services or products from subcontractors due to circumstances stated herein, this shall constitute grounds for relief that entails postponement of the time of performance and release from any penalty, damages and other sanctions. The Supplier shall not be liable for delayed delivery or the User’s costs incurred due to the above-mentioned circumstances beyond the Supplier’s control.

10. Reservations
The Supplier disclaims, to the extent permitted by applicable law, all liability for any direct and/or indirect damage, both material and personal, incurred by the User and/or third parties in connection with the use of the Product.
The Supplier reserves the right to make changes to, for example, prices, availability, printing errors in written documents on the Supplier’s website.
If any provision of the Terms is held to be illegal, invalid or unenforceable for any other reason, such provision shall be deemed omitted and shall not affect the validity or enforceability of any of the remaining provisions of the Terms.

11. Cookies
The provider uses cookies and similar technologies on its website. https://www.pushpucks.com/. When visiting https://www.pushpucks.com/ the Supplier processes data such as browser settings, platform and user-generated data (such as visit and click history).

11.1 Why does the Provider use cookies
Cookies are small text files consisting of letters and numbers. These are sent from the Provider’s web servers and stored on the user’s device as described below. The cookies used by the Supplier normally improve the website and the services offered by the Supplier. Some of the Supplier’s services need cookies to function properly, while others improve the User’s experience of the website and services. The Provider uses cookies to collect overall analytical information regarding the use of the Provider’s services. The Supplier also uses cookies to target relevant marketing to the User.

11.2 How can the Supplier’s use of cookies be controlled
The browser or device used often allows the User to control the settings for the use and scope of cookies. In the settings of the browser or device, information can be found on how to adjust the settings for cookies. For example, the user can choose to block all cookies, accept only first-party cookies or delete the cookies saved when the browser or device is closed. Please note that some of the Provider’s services may not function optimally if the User were to choose to block or delete cookies, such as certain information on the website becoming inaccessible or information loading more slowly.
The Swedish Post and Telecom Authority is the authority that oversees the areas of electronic communications and postal services in Sweden.

12. Dispute
Rights and obligations under the Agreement, the Terms and Conditions and related legal relationships are governed by Swedish law.
In the event of a dispute between the User and the Supplier, such dispute shall in the first instance be resolved by direct communication between the User and the Supplier. By accepting the Terms and Conditions, the User agrees not to engage in any form of activity or communication with a third party, public or private, that will lead to public defamation of the Supplier.
In the event that a dispute cannot be resolved through direct communication, disputes regarding the interpretation or application of the Agreement, the Terms and Conditions and related legal relationships shall be settled by the Swedish general court.

13. Contact us
If the User wishes to contact the Supplier on matters relating to the Service, the User shall contact the Supplier on telephone number 08-6530080.
If the User wishes to report a fault in the Product, the User shall contact the Supplier without delay by calling the above telephone number.
The Supplier does not guarantee any specific time availability for customer service-related matters, but will endeavor to respond to requests from the User as quickly as possible.
